I think we’re out in 36 hours. Not sure how correct this is, as i’ve just c&p’d someone else comment, but if any of it is correct, the games already over.

Gov suggesting the SI is only to avoid ambiguity in application of EU law between now and 12 April and that exit date has already been extended by PM under the Royal Prerogative, but the European Union (Withdrawal) Act 2018 is very clear: before a minister can change the date Parliament needs to vote on the change of time and date (see Schedule 7 para 14) and S20 para 4.

In other words:

Gov misleading by suggesting that there is already a binding extension as to the exit date as there is not and won’t be without a valid vote; and

Gov also only entitled to amend under the 2018 Act by amending the exit date to a new exit time and date and not to amend to two alternate dates.

Therefore (a) if this SI vote does not go through this evening we crash out and (b) if this vote goes through it may be challenged on the basis that it poses not one new exit dates but two and is therefore ultra viries and invalid in which case we crash out.

Bill Cash made this point last night (the si was passed) and the Governments position is that their legal advice confirms the extension is valid. Whether that will stand up against any appeal? Who knows?

I’ve wondered how all this shit will affect countries wavering in their own support for the EU project, like Italy, Greece, etc. Now they’ve seen how difficult it is for even the most sceptical of all the EU members to extricate ourselves from the project, will they just submit to full integration because its not worth the effort of resisting, or want to get out before it really is too late? :thinking:

I’m glad we’re putting up a fight to get out of this, any goodwill to the EU has gone along with our own politicians who are ignoring their own constituents desire to leave.

No, and that’s not what I meant. I’d say the EU have probably done more than I’d ever expected of them in the circumstances, it’s our own politians who are fucking up the works.

I concur that our own, self interested, MPs have fecked this up but I don’t hold the EU elite entirely exonerated either.

Yes I know they’re doing their utmost to protect their interests but there seems to be very little give from them. Almost like they are trying to make a point to the wavering nations.

Pretty much expected that of them, but for all the carping about May’s deal I don’t see they could have offered much more, tbh. And I’m generally in favour of leaving.

They were always going to offer a shit deal. We should have just left. Now we are in a position where the EU hold all the cards.
