The judges didn’t seem to think it was thought out very well.

“Moreover, in light of the government’s shifting interpretations of the executive order, we cannot say that the current interpretation by White House counsel, even if authoritative and binding, will persist past the immediate stage of these proceedings.”

They also seem to believe they have a say in legal matters.

The panel wrote “although courts owe considerable deference to the president’s policy determinations with respect to immigration and national security, it is beyond question that the federal judiciary retains the authority to adjudicate constitutional challenges to executive action”.

I must be stupid, because i see a bunch of ideological fools making it up as they go along. Seems the judges do as well.

Have you noticed how the word alien(what happened to illegal immigrants) keeps getting repeated? Almost as if they are trying to dehumanise those pesky foreigners.

Hasn’t the US always used that term?

As I said they can say what they want but in the US they’re seen as the bad guy weakening the President (he’ll get it through eventually or “lose” play the martyr get reform and still have his agenda on the table) and executive orders, to me it is very very clever, he can’t not win, very clever by his advisors, any terrorist activities from now on who do they blame?
Will he now ask for more powers as he can’t fully implement what he said he would do?

Its clever plain and simple as he has boxed in his opponents.

Its known to foreigners of Muslim faith they are not wanted from the highest echelons in power in the US, Trump and his administration have put that on the table and laid any future blame on a terrorist attack on the judiciary and not his policies.

1798 they started using it so I’ve just read, didn’t know it was that long, I would have guessed from the mid 1800’s due to the Irish famine etc etc.

@barry-sanchez You say clever, i say stupid.They change with the wind and if this is their best effort at “policy that has been years in the making” you should be worried about their ability. Eventually all but the most stupid will get sick of it(history may not be on my side here).

I do remember the term illegal alien, but now it’s just alien and it’s slipped in as much as is possible, whilst keeping a sentence coherent(never thought i’d use the word coherent when discussing trump). Why is that?

You missed out cronyism(whole lot more than just nepotism going on), don’t forget that.

His lawyers didn’t appeal hard by all acounts, clever.

He has an out if there is an attrocity.

He can then ask for more powers weakening the judiciary and getting more for his administration and future Presidents.

He has made it clear he doesn’t want people of Muslim faith coming in to the Country.

This was a clever plan and ruse from the start, politics plain and simple and if people believe this is good then they’re very naive, this has boxed in the left, liberals and judiciary.

It is a very clever political move that boxes in his opponents, say what you want about Trump and his intellect and ideas etc but his administration buy news sources say he has got the best ever.

He is bringing out the opposition into the light and if it goes wrong they’ll get the blame, if nothing happens he can still say he cant execute his directives as the liberal courts are in the way.

Very cute and the democrats must have seen this and knew thee was nothing they could do about it.

Ok, if they are doing their jobs, why will it go through on appeal if the appeal judges also do their jobs?

The judge listens to the case and then acts upon it, his position doesn’t change it is up for the lawyers to make the case, by all accounts they didn’t, here is a quote from the BBC

“Donald Trump’s lawyers did not make their case. In fact, according to three 9th Circuit judges, they did not even really try to make their case. Rather than explaining why the temporary travel ban was needed, the administration argued that the president’s authority on immigration was so sweeping that they did not have to explain why the order was necessary.”

If Donald is serious about protecting American lives, perhaps he should put all of the effort he is currently spending in trying to keep Muslims out into dealing with gun crimes. Even for someone as blinkered as him, he must know that Americans are at greater risk from each other than they are from foreign terrorists. If Donald is really intent on putting America and Americans first, perhaps he should go after the NRA?
