As you say, it was a horrid case. It was a different jury and as we have seen, different people view the situation in different ways. I still cant believe that OJ Simpson got off with murdering his ex-wife and her friend or that Oscar Pistorius was only originally convicted with manslaughter but there we go. I can only assume that the jury felt that she had previous and that the likelihood is that she did consent. By his own admittance he did not ask her. He assumed that she was up for it I suppose because she didnt say no and let it happen. I am sure we have all been at that state where we so drunk that we do things that we wouldnt normally do and that is why the prosecution was brought. It was felt that she was in no fit state to consent. You would like to think that a decent human being would take note of the situation and not take advantage - and the law is there to protect people from those that do. Not only did he balg his was into the room (to see if he knew the girl apparently - couldnt his maate either of found out her name and told him via a text or sent him a picture) and then he goes down on her and has sex with her all without saying a word to her. He then goes out of the fire exit. This is a man who says he can have any girl he wants. So why then go with one who has just shagged his mate and who is clearly out of it? Lets not forget he has a partner by whom he has a young child with. It is interesting that her sexual past was brought up but not his. Are we to believe that this is the only time he has been out after a cheap shag?
My problem with this case though is in the first trial where his mate got off and he was convicted. If the jury believed that she was too drunk (or high) to consent to Evans, why was she not too drunk to consent to McDonald. The CCTV footage clearly shows that she was all over the place and not in control of herself before she went to the hotel room. Does getting into a taxi when smashed mean you consent to sex? McDonald is just as much of a sexual predetor as Evans. They both took advantage of the situation.
There are clearly those who feel that these two did no wrong. The girl is clearly a “slag” and is up for it despite being out of her head. To those people I would say how would you feel if, after a heavy night out you woke up naked in a hotel room somewhere not remembering what happened the night before and with a sore arse because you had the misfortune to come across a couple of people who were looking for a cheap thrill rather than people who would have put you in a taxi and made sure you got home safely?
