Yes Scotty. When you hear some of the remarks made about why and how some jurors have reached their decisions it makes you shudder. But then it’s no different to reading football forums :wink:. Sadly there is no perfect legal system. Outs isn’t bad by any means, but like anything, as soon as you get more than one human being involved in the process it will always be prone to issues.

I raised the topic about professional juries because the subject used to come up occasionally in the CPS. I don’t think we ever came to a conclusion because there are pros and cons for both. I expect the defence would say similar, although we thought that they would be better off with the current system as we felt it would be easier to cast doubt in the minds of people not used to the system (but then we would think that wouldn’t we).

Of course juries aren’t the issue. There is an inconsistency in the judiciary and amongst the barristers. The law is all about levelling up the playing field but the better your legal team, the better chance you have of things going your way.

One of my jobs was booking counsel to prosecute our cases and I was given updated lists on those to use and not to use based on our perceived level of competence. Same with our in house lawyers. Some I would use more for court and others more for charging decisions in the office.
